A Certified Private Fiduciary is an individual, licensed by the Arizona Superior Court, who serves by court appointment in several capacities, on behalf of an individual who cannot execute those duties themselves. The Fiduciary essentially acts as a ‘stand-in’ for an incapacitated person, acting solely for the benefit of that person.
A fiduciary can serve as a court-appointed conservator of a protected person’s finances, personal representative or executor of an estate. A fiduciary may also serve, by agreement of interested parties, as trustee, agents under powers of attorney, or as representative payee for structured income plans.
A licensed fiduciary, serving in private practice as we do, does so for a fee. If required, the fees collected by a fiduciary are submitted on an annual basis to the Arizona Superior Court for review and must be approved.
Ultimately, our principle focus is that the fiduciary relationship is one of trust and the well-being of the protected person or entity. A fiduciary is accountable to the Court for all decisions made on behalf of a protected person. Any action taken on behalf of a ward must benefit the ward, while maintaining the highest degree of autonomy possible. If required, a bond will be secured. Our license to operate must be maintained in good standing.
Under Arizona law, a conservator can be appointed for a person who suffers from mental illness, mental disorder, physical illness or disability, chronic use of drugs, chronic intoxication or confinement, disappearance or detention by a foreign power. Appointment of a conservator can only be made when the court finds that there are assets that will be wasted or dissipated without proper management or that provision must be made for the care of the ward or his dependents.

Michael attend Arizona State University and graduated with a Bachelor’s degree with an emphasis in accounting and became a Certified Public Accountant in 1975. He became a Private Fiduciary in 1980 and founded Conservators of Arizona, Inc. in 1985. Michael was one of the first certified through the Arizona Superior Court. Certification number 20226.
